Acceptable Use Policy

1. Introduction

This Acceptable Use Policy ("AUP") governs the use of the MAGK Tech platform, including all software, services, APIs, network infrastructure, hardware nodes, and related systems (collectively, the "Platform") provided by MAGK, LLC ("Provider," "we," "us," or "our").

By accessing or using the Platform, you ("User," "you," or "your") agree to comply with this AUP. This AUP supplements and is incorporated into the MAGK Tech Proprietary Software License and the Terms and Conditions. In the event of a conflict, the Terms and Conditions shall control.


2. Authorized Use

2.1 Permitted Activities

Users who have been granted an explicit written license may use the Platform only for the following purposes:

  • (a) Tactical communications and situational awareness operations as intended by the Platform's design.
  • (b) Military simulation, training exercises, and emergency response coordination.
  • (c) Administration and management of TAK server infrastructure through the provided web interface.
  • (d) Client device onboarding via QR code generation and certificate management.
  • (e) Event planning, mission coordination, and team management through authorized interfaces.
  • (f) Monitoring system health and performance through provided dashboards and APIs.
  • (g) Integration with authorized TAK-compatible client applications (e.g., ATAK, iTAK, WinTAK) via supported protocols.

2.2 License Requirement

All use of the Platform requires a valid, written license agreement from Provider. Unauthorized access or use is strictly prohibited and may result in civil and criminal penalties.


3. Prohibited Activities

3.1 Security Violations

Users shall not:

  • (a) Attempt to gain unauthorized access to the Platform, other user accounts, or any systems or networks connected to the Platform.
  • (b) Probe, scan, or test the vulnerability of the Platform or any associated system or network, or breach any security or authentication measures.
  • (c) Intercept, monitor, or tamper with data transmissions between Platform components, including but not limited to CoT (Cursor on Target) messages, API communications, WebSocket connections, and node-to-server communications.
  • (d) Deploy or distribute malware, viruses, worms, Trojan horses, or any other malicious code or content through or against the Platform.
  • (e) Conduct denial-of-service attacks, flooding, or any activity intended to disrupt the availability or performance of the Platform.
  • (f) Exploit any bug, vulnerability, or error in the Platform, whether known or unknown, for any purpose other than promptly reporting it to Provider.

3.2 Reverse Engineering and Modification

Users shall not:

  • (a) Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or data structures of any component of the Platform.
  • (b) Modify, adapt, translate, or create derivative works based on the Platform or any component thereof.
  • (c) Remove, alter, or obscure any proprietary notices, labels, or markings on the Platform.
  • (d) Bypass, disable, or circumvent any technical protection measures, access controls, license enforcement mechanisms, or digital rights management features.

3.3 Unauthorized Data Activities

Users shall not:

  • (a) Scrape, harvest, crawl, or use automated means to extract data from the Platform without explicit written authorization.
  • (b) Access, collect, store, or process personal data of other users in violation of applicable privacy laws or without proper authorization.
  • (c) Use the Platform to store, transmit, or distribute any content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
  • (d) Exfiltrate, copy, or transfer any proprietary data, configurations, or operational information from the Platform.

3.4 Misuse of Services

Users shall not:

  • (a) Use the Platform for any purpose other than its intended tactical communications and administration functions.
  • (b) Resell, sublicense, lease, or otherwise commercially exploit access to the Platform without explicit written authorization from Provider.
  • (c) Use the Platform to develop, train, or improve any competing product or service.
  • (d) Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
  • (e) Use the Platform in any manner that violates applicable local, state, national, or international laws or regulations.
  • (f) Interfere with or disrupt the use and enjoyment of the Platform by other authorized users.

3.5 Hardware and Node Restrictions

Users shall not:

  • (a) Tamper with, modify, or reverse engineer MAGK hardware nodes (SD2, Domination, Network Nodes) or their firmware.
  • (b) Connect unauthorized devices or hardware to the MAGK node network.
  • (c) Intercept, jam, or interfere with HaLow (802.11ah) or mesh network communications between nodes and the Platform.
  • (d) Attempt to extract encryption keys, certificates, or authentication credentials from hardware nodes.

4. Reporting Obligations

4.1 Security Incidents

Users must promptly report to Provider any known or suspected:

  • Security breaches or unauthorized access to the Platform.
  • Vulnerabilities discovered in the Platform.
  • Unauthorized use of credentials or accounts.
  • Loss or theft of hardware nodes or devices with Platform access.

5. Monitoring and Enforcement

5.1 Right to Monitor

Provider reserves the right to monitor use of the Platform to ensure compliance with this AUP. Such monitoring may include reviewing access logs, API usage patterns, network traffic, and system activity.

5.2 Enforcement Actions

Violations of this AUP may result in, at Provider's sole discretion:

  • (a) Warning and request for corrective action.
  • (b) Temporary suspension of access to the Platform.
  • (c) Permanent termination of access and all license rights.
  • (d) Pursuit of civil remedies, including injunctive relief and damages.
  • (e) Referral to law enforcement authorities for criminal prosecution.

5.3 No Liability for Enforcement

Provider shall not be liable for any damages resulting from enforcement actions taken in good faith under this AUP.


6. Modifications

Provider reserves the right to modify this AUP at any time. Material changes will be communicated to licensed users through reasonable means. Continued use of the Platform after notification of changes constitutes acceptance of the modified AUP.
